What policy covers legal liability?
What’s covered
We cover your legal liability to pay compensation for:
- death or bodily injury to other people;
- loss or damage to their property,
resulting from an incident that happens during the period of insurance. The limit of liability is $20 million in total for an incident.
Home legal liability
If you have home cover, we cover legal liability in relation to the instances outlined in the “What’s covered?” section in relation to:
- in connection with you owning or living in the home; and
- at the insured address.
Contents legal liability
If you have contents cover, we cover legal liability in the instances outlined in the “What’s covered?” section that occurs anywhere in Australia or New Zealand:
- which is unrelated to your ownership of the home, unit or land at the insured address; or
- if it results from fixtures and fittings attached to the insured address that you are legally responsible for under a rental agreement; or
- which is related to your ownership or occupation of the unit at the insured address, and your legal liability is not covered under a home/building policy that covers that unit.
Additional cover for a new vacant block of residential land
If you have contents cover we cover legal liability in relation to the instances outlined in the “What’s covered?” section that occurs on a vacant block of land that:
- you own;
- is zoned for residential housing;
- is no more than 20 acres; and
- is where you intend to build your future home.
We only provide cover for incidents that happen in the first 12 months of you owning the property. Cover will end if you sell the land or any building/rebuilding commences on the land.
Additional cover for your block of land when the home was damaged
We cover legal liability in relation to the instances outlined in the “What’s covered?” section that occurs when:
- both the home and contents are insured with us at the time the home is badly damaged or destroyed by an insured event; and
- we pay you the full home sum insured and the cover for the home stops.
We will continue to cover your legal liability resulting from an incident that happens at the insured address for up to 12 months under your contents policy. Cover will end if:
- any building commences;
- repairs or rebuilding worth more than $50,000 commences;
- you cease to insure your contents under the policy.
Legal costs
We also cover your associated legal costs for a claim against you that is covered. We need first to agree to pay the legal costs before they are covered.
Limits
The most we will pay for all claims from any one incident for legal liability covered by our policy is $20 million, including all associated legal costs. Conditions and exclusions apply. You can find more information on this policy in the Product Disclosure Statement.
What’s not covered
Loss or damage to, or caused by, connected with or arising from, or liability caused by, connected with or arising from:
- Agreements you enter into (unless the liability would have existed in the absence of agreement);
- Using or owning Aircraft or facilities for aircraft;
- Animals (other than your domestic dog, cat or horse);
- Asbestos;
- Business activity;
- Building work at the insured address where the cost exceeds $50,000;
- Caravans and trailers;
- Committee members or officials – actions or duties as a committee member or director of a club or association or as a coach, referee, official;
- Death or injury;
- Defamation or copyright;
- Drones;
- Erection or demolition;
- Fines, penalties and other damages;
- Legal actions in other countries;
- Motor vehicles or motorcycles;
- Property owned by you or property in your physical or legal custody;
- Watercraft;
- Your employees.
